Meeting:        Salem Licensing Board held Monday, April 11, 2011 at 6:00 pm in the third floor conference room, 120 Washington Street. Present were members: Robert St. Pierre, chairman, members Rick Lee and John Casey, Investigator for the Board, Lt. Ouellette and Melissa Pagliaro, Clerk.
        
Approved:       Application for a Street Performers License. Applicant: Royal Sorel
        Mr. Sorel said he has been doing balloon twisting for a long time and that this is a renewal of his license.
        Mr. Casey asked how last year was.
        Mr. Sorel said it was good.
        Mr. Casey motioned to approve.
        Mr. Lee seconded. Mr. St. Pierre said all were in favor. Motion carries.        

Approved:       Application for a Street Performers License. Applicant: Kevin Sinclair
        Mr. St. Pierre asked what he performs.
        Mr. Sinclair said that he is a singer and songwriter.
        Mr. Casey asked if this was his first year applying for a license in Salem.
        Mr. Sinclair said he lives on the North shore but that this is his first year applying.
        Mr. Casey went over the rules for the license. He said that performing hours are from 10am-8pm, no passing of hats only something stationary can be put out, and no amplification.
        Mr. Casey motioned to approve.
        Mr. Lee seconded. Mr. St. Pierre said all were in favor. Motion carries.

Approved:       Application for Blanket License for Entertainment for MA Poetry Festival. Present: Colleen Michaels, MA Poetry and Ellen Talkowsky.
        Ms. Talkowsky said that the City is working with the MA Poetry Festival this year to host it in Salem. She said this is their 3rd year but first year in Salem. She said it will be held downtown in Derby Sq.
        Ms. Michaels said that she is a representative for MA Poetry. She said that she is in charge of the entertainment for Derby Sq.
        Ms. Talkowsky said there will be some Salem restaurant selling food, music and poets.  She said this event should bring between 1200-2000 people to the downtown on the 15th.
        Mr. Casey motioned to approve.
        Mr. Lee seconded. Mr. St. Pierre said all were in favor. Motion carries.

Approved:       Application for a Street Performers License. Applicant: Sean Augelewicz
        Mr. Casey asked what he would be performing.
        Mr. Augelewicz said he plays the guitar and sings. He said he lives in Peabody and had a license last year.
        Mr. Casey went over the rules for performing.   
        Mr. Casey motioned to approve.
        Mr. Lee seconded. Mr. St. Pierre said all were in favor. Motion carries.
                


Approved:       Application for Street Performers License. Applicant: Michael and Maria LoPresti.
        Mr. & Mrs. LoPresti said that they are renewing their licenses. He said that they dress up and portray the pirates from the movie “Pirates of the Caribbean” and take pictures with visitors. He said with a new movie coming out he expects lots of interest this year.        
        Mr. Casey motioned to approve.
Mr. Lee seconded. Mr. St. Pierre said all were in favor. Motion carries.

Approved:       Application for a Store Fortune Telling License. Applicant: Phyllis Brewer Brown. Present: Ms. Brown and her husband.
        Mr. St. Pierre asked her what she was interested in doing.
        Ms. Brown said that she is opening a new store called Past-Present-Future at 131 -1 Essex Street where Angels Landing used to be.
        Mr. Casey asked if she knew the rules on merchandise having to be a t least 50% metaphysical in nature.
        Ms. Brown said that it was.
        Mr. Casey motioned to approve.
        Mr. Lee seconded. Mr. St. Pierre said all were in favor. Motion carries.

Approved:       Application for Sub-licensee at Past-Present-Future. Applicant: Linda Weinbaum.
        Mr., Casey asked her what she would like to do.
        Ms. Weinbaum said she would like a license to read at Ms. Browns new store.
        Mr. Casey asked if she had read before.
        Ms. Weinbaum said she is a clairvoyant who has read for a very long time in Salem. She holds an Individual license and other sub-licenses for other stores.
        Mr. Lee motioned to approve.
        Mr. Casey seconded. Mr. St. Pierre said all were in favor. Motion carries.

Approved:       Application for two sub-licenses at Salem Chapel, 57 Wharf Street. Applicants: Therese DeVoe and Katrina Kessler.
        Rev. Donald Lewis, license holder for the Salem Chapel was present for Ms. Kessler as she could not make it tonight. Ms DeVoe was present.
        Mr. Casey asked Ms. DeVoe if she has read in the City before.
        Ms. DeVoe said that she has had a store for the last eight years in Salem that she has to give up and that she has read for over 40 years.      
        Mr. Casey motioned to approve two readers at the Salem Chapel.
        Mr. Lee seconded. Mr. St. Pierre said all were in favor. Motion carries.



Approved:       Application for a Common Victualler License. Applicant:
        Present: Attorney Peter Lim and, owner
        Mr. Casey asked Mr. if he had a background in food.
        Mr. said he has worked at various fast food establishments for years.
        Mr. Casey said the approval is contingent upon the Department getting the rest of the necessary paperwork and said a condition on the license will be that the front of the restaurant has to be swept clean everyday. Also listed on the license will be the order that the owner must comply with the State Fire Marshall laws regarding vent and filter regulations.
        Mr. Lim said the menu will stay the same.
Mr. said the hours will be from 11am-9:45pm, 7 days.
Mr. Casey motioned to approve.
Mr. Lee seconded. Mr. St. Pierre said all were in favor. Motion carries.
        
Approved:       Matt Caruso for Salem Jazz and Soul Festival. Mr. Caruso is seeking a Blanket vending License, an Entertainment License and Two One Day Liquor Licenses.  
        Mr. Caruso said that this is the 5th year and they have raised just under $20,000 for music programs in the City. He said he is looking for an Entertainment License from May-July, the second Saturday of each month. He said the Entertainment will be in Derby Sq. from 4-8pm.
        He said for the day in May that is the same as the Poetry Fest they are in contact with each other and have worked it out. He also would like Entertainment for two days at the Willows on August 20 & 21st.  Hours will be from 10am-8pm on Saturday and 11am-6pm on Sunday. He said the Park and Rec. has given their permission.  
        Mr. Casey asked about rain dates.
        Mr. Caruso said where they have bands booked it is a rain or shine event.
        Mr. Casey asked how the non profit makes money.
        Mr. Caruso said through sponsorships.
Mr. Casey motioned to approve the Entertainment License.
Mr. Lee seconded. Mr. St. Pierre said all were in favor. Motion carries.

        Mr. Caruso said that next was the two One Day Liquor Licenses. He said that it was the same as last year, which was problem free, except for the hours. He said he’d like to change the hours to 2-7 on Saturday and 2-6 on Sunday and they would like to add wine.
        Mr. St. Pierre asked if he’s been in touch with the police.             
        Mr. Caruso said that he has been working this out with them and they will have 4 detail officers. He said there will be an officer for parking, one for the bandstand, and two walking around.
        Mr. Casey asked about severs.
        Mr. Caruso said they will be TIPS certified as in the past.
        Mr. St. Pierre asked Lt. Ouellette if he was aware of any issues from last year.
        Lt. Ouellette said he was not.
Mr. Casey motioned to approve the two One Day Licenses.
Mr. Lee seconded. Mr. St. Pierre said all were in favor. Motion carries.

Mr. Caruso said for the Blanket Vendor License it will be for about 40 vendors and he will submit a list of the vendors to the Licensing Dept. along with CORI’s on the vendors as in the past.  He said no food will be sold because of the food stand in business already at the Willows.
Mr. Casey motioned to approve the Blanket Vendor License.
Mr. Lee seconded. Mr. St. Pierre said all were in favor. Motion carries.

Approved:       Application for a Seasonal Beer & Wine License at 75 Willson Street, The Salem Golf Course. Present: Bill Laganis and Aaron Cyr.
        Mr. Laganis said that he and Mr. are taking over the stand at the Golf Course.
        Mr. St. Pierre asked what the hours are going to be.
        Mr. Laganis said that they will close the course at seven but they d like to be able to have people stay around until about 11 pm to eat and drink. He said the lease with the City gives them until 11pm.
        Mr. Casey asked if that would be 7 days a week.
        Mr. Laganis said it would be 7 days from 6am until 11pm.
        Mr. St. Pierre said they cannot serve alcohol that early.
        Mr. Lee asked who the manager was going to be.
        Mr. Cyr said he would be.
        Mr. Casey said that a condition of the license would be that they were TIPS or equivalent certified.
Mr. Casey motioned to approve with the condition that the rest of the paperwork be completed and that the men are TIPS certified.
Mr. Lee seconded. Mr. St. Pierre said all were in favor. Motion carries.

Approved:       Application for a Street Performers License. Applicant: Simon Zasvalsky.
        Mr. Casey said that Simon was here last year.
        Mr. Zasvalsky said he is a violinist.
        Mr. Casey asked hoe last year was.
        Mr. Zasvalsky said he plays at Faneuil Hall in the summertime so he hopes to be in Salem more this year.
        Mr. Casey went over the rules and regulations for Street Performing.
Mr. Casey motioned to approve.
Mr. Lee seconded. Mr. St. Pierre said all were in favor. Motion carries

Discussion:     The Exchange on Congress, 75 Congress Street.
        Present: Joe Costanzo, buyer and Arthur Beradino, property owner and pledge holder of license.
        Mr. St. Pierre said he understands the potential buyer is having issues with the current Manager.
        Mr. Costanzo said that he is having trouble getting the paperwork signed for the Transfer. He said he took the banner down that he put up with the new name of the restaurant because he now understands that change has to have approval of the ABCC. He said that he has had everything set to go and has the place stocked with food. He said it is all cleaned up and repainted.
        Mr. Lee asked what his status with the current owners is.
        Mr. Costanzo said that it is very inconsistent. He said the manager said that his father is sick and he cannot get anyone to sign the documents he needs to complete the transfer.
        Mr. St. Pierre asked when that was supposed to happen.
        Mr. Costanzo said on March 14.
        Mr. Casey asked what the Board might do to help.
        Mr. Costanzo said that the Board could allow him to operate under The Exchange as they said they would do back in February until he can track the Corbin’s down. He also asked if the Board would somewhat reinstate the Entertainment License just so he could have a TV for the Red Sox games.
        Mr. Casey requested that the Board call Mr. Corbin in for a Hearing.
        Mr. St. Pierre said he would like to see this transfer made and that Mr. Costanzo could open.
        Mr. Casey said he didn’t see a problem with that.
        Mr. St. Pierre said he’d like to work with him to keep the business open.
        Lt. Ouellette said he thinks it is important to get a letter out for Hearing so the Board can address the Owner or Manager as Mr. Costanzo is not either yet.
        Mr. Beradino said he is the owner of the property and also the Pledge Holder. He said he has already filed legal action against the Corbin’s for monies owed in rent and that they have not shown up for legal proceedings either. He said that Mr. Costanzo has paid all of the Corbin’s outstanding debt that was owed to him.
        Lt. Ouellette said if a Hearing is held then the LB can revoke or suspend the License if Mr. Corbin does not show up.
        Mr. St. Pierre said that he is concerned about revoking it because he does not want to lose it.
        Lt. Ouellette said that the LB gave him permission to open and he did not, He said the license is supposed to be convenient to the public.
        Mr. St. Pierre said that he would like a vote to bring Mr. Corbin in for a Hearing.
        Mr. Costanzo said he’d like to be able to open because he has invested a couple of thousand dollars in food already.
        Mr. Lee motioned to allow the Exchange to stay open and to call Mr. Corbin in for a Hearing on April 25th  and to allow Mr. Costanzo to have a TV.
         Mr. Lee seconded. Mr. St. Pierre said all were in favor. Motion carries
        


Approved:       Attorney Michael McMahon for Palmers Cove Yacht Club for Change of Manager.
        Atty. McMahon said that the proposed Manager was ill and could not attend tonight so he is here for him. He said the applicant is for a Change of Manager to Richard Moreau. He said that Mr. Moreau is not TIPS certified but that he told him that would most likely be a requirement.
        Mr. Casey asked if Mr. Moreau was aware that he would have to be on the premises for at least 40 hours a week.
Atty. McMahon said he would be there more than that.
        Mr. Casey motioned to approve Change of Manager with the stipulation that he is TIPS or equivalent certified.
        Mr. Lee seconded. Mr. St. Pierre said all were in favor. Motion carries

Business:       *Lt. Ouellette asked the LB to call in Strega as they have been closed and did not notify the Board of the closure.     
 Mr. St. Pierre at first said to send a letter to her home but then agreed with Lt. Ouellette to call her in for a Discussion on April 25th.
